By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking or allowing our team to commence any work.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Company means Rubbish Removal Wembley, the waste collection and rubbish removal service provider.

Customer means any person, business, organisation, or other entity that books or receives services from the Company.

Services means any rubbish removal, waste collection, loading, transportation, clearance, or related services provided by the Company.

Waste means any items, materials, or rubbish agreed to be collected, removed, or disposed of by the Company in accordance with applicable waste regulations.

Booking means a confirmed request for Services made by the Customer and accepted by the Company.

2. Scope of Services

The Company provides waste removal and rubbish collection services, including but not limited to household rubbish, garden waste, office clearance waste, bulky items, and general non-hazardous waste. Services are offered within the Company’s designated service area, which includes Wembley and surrounding locations, subject to availability.

The Company reserves the right to refuse to collect any Waste that is not as described at the time of booking, that is unsafe to handle, that constitutes hazardous or prohibited waste, or that would cause the Company to breach any law, regulation, or licence condition.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form, or any other method made available by the Company from time to time. The Customer is responsible for providing accurate and complete information about the Waste to be collected, the collection address, access details, and any relevant timing restrictions.

3.2 A Booking is only confirmed when the Company has accepted the request for Services and provided the Customer with confirmation. The Company may decline a Booking at its sole discretion, including where there is insufficient capacity, inadequate access, or where the nature of the Waste falls outside the scope of the Company’s Services.

3.3 The Customer must notify the Company of any changes to the Booking details as soon as reasonably possible. The Company will use reasonable efforts to accommodate changes but cannot guarantee that all requested changes will be possible. Additional charges may apply where changes affect the time, location, or volume and type of Waste.

3.4 The Customer must ensure that an authorised person is present at the collection address at the agreed time to provide access, confirm the Waste to be collected, and approve any variations to the quoted price where necessary.

4. Estimates, Quotes and Pricing

4.1 Any price, estimate, or quote provided before the Services are carried out is based on the information supplied by the Customer concerning the type, volume, and accessibility of the Waste.

4.2 If the actual volume, weight, type, or nature of the Waste differs from that originally described, or if access is more difficult than advised, the Company may adjust the price accordingly. Any revised price will be communicated to the Customer before the work proceeds. If the Customer does not agree to the revised price, the Company may cancel the Booking, and a call-out or cancellation charge may apply.

4.3 All prices are stated exclusive of VAT unless clearly indicated otherwise. The Customer is responsible for paying any applicable VAT and any other taxes or charges relevant to the Services.

5. Payments and Invoicing

5.1 Payment is due in full on completion of the Services, unless otherwise agreed in writing in advance. The Company may, at its discretion, require part or full payment in advance at the time of Booking.

5.2 The Company accepts payment by cash, debit or credit card, bank transfer, or other payment methods as notified to the Customer. The Company is under no obligation to release receipts, waste transfer notes, or other documentation until full payment has been received.

5.3 Where credit terms are agreed for business Customers, payment must be made within the agreed period of the invoice date. The Company reserves the right to charge interest on any overdue sums at the statutory rate applicable in England and Wales, accruing daily until payment is received in full.

5.4 If the Customer fails to pay any amount due, the Company may suspend further Services, withhold documentation, and may instruct a third-party debt collection agency or legal representatives to recover the outstanding amount. The Customer will be responsible for all reasonable costs incurred by the Company in recovering sums owed.

6. Cancellations, Rescheduling and Waiting Time

6.1 The Customer may cancel or reschedule a Booking by giving the Company reasonable notice. Specific cancellation periods and charges may be communicated at the time of Booking. Where less than 24 hours notice is provided, the Company reserves the right to charge a late cancellation fee, up to the full quoted amount.

6.2 If the Company arrives at the collection address and is unable to gain access, or if the Waste is not available or differs substantially from the description provided, the Company may treat the Booking as cancelled by the Customer and may charge a call-out or cancellation fee.

6.3 The Company aims to attend at the agreed time but cannot guarantee specific time slots. Circumstances such as traffic conditions, vehicle breakdowns, adverse weather, or other events beyond the Company’s reasonable control may cause delays. In such cases, the Company will make reasonable efforts to inform the Customer and rearrange, but shall not be liable for any loss, cost, or inconvenience resulting from such delays.

6.4 Waiting time charges may apply where the Company’s vehicle and staff are kept waiting beyond a reasonable period due to issues with access, authorisation, or preparedness of the Waste. Any applicable waiting time charges will be notified to the Customer.

7. Customer Responsibilities

7.1 The Customer is responsible for ensuring that:

The Waste to be collected is accurately described at the time of Booking.

Safe and reasonable access is available for the Company’s vehicle and staff.

Any necessary permissions, permits, or authorisations for access or loading are obtained.

There are no health and safety risks beyond those reasonably associated with normal rubbish removal operations.

7.2 The Customer must inform the Company in advance if any Waste includes sharp objects, heavy items, or materials that require special handling. The Company may decline to remove any Waste that it considers unsafe to handle.

7.3 The Customer must not include in the Waste any substances or items that are hazardous, prohibited, or restricted under applicable environmental or waste management regulations, including but not limited to asbestos, chemicals, solvents, medical waste, pressurised cylinders, or flammable liquids, unless the Company has specifically agreed in writing to collect such items in compliance with relevant laws.

8. Waste Handling and Regulations

8.1 The Company is committed to operating in accordance with applicable UK waste management and environmental regulations. Waste will be transported and disposed of at licensed facilities wherever required by law.

8.2 The Company may issue waste transfer notes or other statutory documentation as required for certain types of Waste or for business Customers. The Customer must retain such documentation for any period required by law.

8.3 Title to the Waste passes to the Company when it is loaded onto the Company’s vehicle, subject to full payment being received. The Company reserves the right to refuse or return any Waste that was misdescribed or unlawfully included, and to recover any associated costs from the Customer.

8.4 The Customer must not request or encourage the Company’s staff to dispose of Waste unlawfully, including fly-tipping or leaving Waste at unauthorised sites. The Company will not accept instructions that would cause a breach of environmental or waste regulations.

9. Liability and Limitations

9.1 The Company will exercise reasonable care and skill in the provision of the Services. However, the Company’s liability to the Customer is limited as set out in this clause.

9.2 Except where prohibited by law, the Company shall not be liable for any indirect, consequential, or special loss or damage, including but not limited to loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services or these Terms and Conditions.

9.3 The Company’s total aggregate liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence, breach of statutory duty, or otherwise, shall not exceed the total price paid or payable for the specific Services giving rise to the claim.

9.4 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

9.5 The Customer is responsible for protecting or removing any fragile items, valuables, or personal belongings near the Waste to be removed. The Company does not accept liability for damage to items that were not reasonably visible or that the Customer failed to safeguard or move prior to the Service.

10. Insurance and Damage

10.1 The Company maintains appropriate insurance cover in respect of its operations, including public liability insurance, in line with industry practice.

10.2 If the Customer believes that damage has occurred to property as a direct result of the Company’s negligence while carrying out the Services, the Customer must notify the Company in writing as soon as reasonably possible, providing reasonable details and, where practicable, photographic evidence.

10.3 The Company will investigate any claims of damage and, where appropriate, may offer repair, replacement, or compensation, subject always to the limitations set out in these Terms and Conditions and the terms of the Company’s insurance policy.

11. Force Majeure

The Company shall not be in breach of these Terms and Conditions or otherwise liable for any delay or failure in performance of its obligations if such delay or failure results from events, circumstances, or causes beyond its reasonable control. These may include, without limitation, severe weather, acts of God, strikes, industrial disputes, accidents, traffic incidents, road closures, or failure of third parties. In such circumstances, the Company may suspend the Services and shall use reasonable efforts to resume them as soon as practicable.

12. Complaints

If the Customer is dissatisfied with any aspect of the Services, the Customer should contact the Company as soon as possible, providing full details of the issue. The Company will investigate complaints and aim to respond within a reasonable timeframe. The Customer agrees to give the Company a reasonable opportunity to investigate and, where appropriate, remedy any complaint before pursuing any other remedy.

13. Variation of Terms

The Company may amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements, or business practices. The version in force at the time of the Customer’s Booking will apply to that Booking. It is the Customer’s responsibility to review the current Terms and Conditions before making a Booking.

14. Data Protection and Privacy

The Company will collect and process personal data provided by the Customer for the purpose of administering Bookings, delivering Services, handling payments, and managing any queries or complaints. The Company will handle such data in accordance with applicable data protection laws. Personal data will not be sold to third parties and will only be shared where necessary for the provision of Services, compliance with legal obligations, or the recovery of debts.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.

17. Entire Agreement

These Terms and Conditions, together with any written confirmation, invoice, or specific agreement between the Company and the Customer, constitute the entire agreement between the parties relating to the provision of the Services and supersede any prior discussions, correspondence, or understandings.

By placing a Booking with Rubbish Removal Wembley or otherwise using the Company’s waste removal and collection Services, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
